We’re absolutely thrilled you’re joining our community of real estate professionals who believe in collaboration, excellence, and transforming the industry together. Just like the Ninja philosophy taught us, success comes from genuine relationships and helping each other grow.

These terms might look lengthy, but we promise they’re here to protect everyone in our community and ensure we can keep building something amazing together. We’ve worked hard to make this as clear and fair as possible, while still covering all the important legal stuff we need to address.

Who We Are and What We Do

Referral Flow is your technology partner in the referral space, and we’re also a licensed real estate broker in California (DRE #02067988). We operate under several names you might recognize, including “Find a Ninja” and other partnerships with amazing brokerages across the country.

Our mission is simple: connect great agents with great opportunities while keeping costs low and results high. Everything we do is designed to help you succeed and advance our industry together.

How This All Works

When you create an account with us, you’re agreeing to these terms. We might need to update them occasionally as we grow and improve (we’re always innovating!), and we’ll post any changes right here on the platform. By continuing to use Referral Flow after we make updates, you’re telling us the new terms work for you too.

Who Can Join Our Community

We’re exclusively for licensed real estate professionals and employees of licensed real estate brokerages (with the express permission of the licensee in charge) who are committed to excellence. When you join, you’re representing that:

  • You hold a current, valid real estate license in good standing
  • All the information you provide us is accurate and complete
  • You’ll keep your profile updated when things change

Important Note About Brokers: Most referral agreements are actually broker-to-broker contracts (you probably know this already!). When you sign up, we’ll ask for your broker’s contact information because they may need to execute agreements on your behalf. Every brokerage handles this differently, so just follow your office policies. If your broker won’t participate in our referral agreements, we unfortunately can’t keep your account active.

Our Confidence Score System

We’ve developed a proprietary confidence score that provides a quick numerical snapshot of how likely an agent is to be an excellent referral partner. This score considers multiple factors to help users make informed decisions about referral opportunities.

Our confidence score algorithm is proprietary and may be updated at any time to improve accuracy and usefulness. We are under no obligation to share the specific details or methodology of our scoring system with users, as this maintains the integrity and effectiveness of the system.

Using the Platform the Right Way

Our platform exists for one primary purpose: facilitating legitimate referral opportunities and professional collaboration between agents. It’s pretty straightforward – connect, refer, succeed, repeat!

Here’s What We Love to See:

  • Agents connecting for genuine referral opportunities
  • Professional collaboration and relationship building
  • Honest, accurate profile information
  • Respectful communication with other agents

Here’s What Breaks Our Community Spirit:

  • Using the platform to mine or collect other agents’ data for non-referral purposes
  • Contacting other users for anything other than referral opportunities
  • Trying to scrape or systematically download agent information
  • Misrepresenting yourself, your license, or your transaction history
  • Using other agents’ contact info for marketing, recruiting, or other business outside of referrals

Why This Matters: We’ve built something special here, and it only works when everyone uses it as intended. Agents who try to misuse the platform or exploit other users’ information will have their accounts terminated immediately. We’re pretty serious about protecting our community.

How We Use Data (And Why It Helps Everyone)

Here’s where we get excited about the future! Your participation helps us do some incredible things that benefit the entire real estate industry. When you use Referral Flow, you’re giving us permission to use the data in ways that keep costs low and create value for everyone.

Making the Platform Better

We analyze how you use the platform, what works, what doesn’t, and how we can improve. Your usage patterns, transaction history, and feedback help us build better features and create a smoother experience for everyone.

Advancing the Industry

We believe in transparency and data-driven improvement. We analyze transaction trends, market patterns, and agent performance to create insights that help the entire industry evolve. Sometimes we share these insights with industry partners, research organizations, and other companies working to improve real estate.

Creating Additional Value for Our Community

We believe in constantly finding new ways to help improve your business and career. As we grow and learn from our platform data, we may identify opportunities to connect you with resources, services, or career opportunities that could benefit you. Our goal is always to use the insights we gather to create more value for our community while helping us continue improving the platform for everyone.

The Bottom Line: All of this data usage serves our core mission – creating a better, more efficient, more collaborative real estate industry while keeping costs low for hardworking agents like you.

Your Privacy: We take data security seriously and follow all applicable privacy laws. For our international users, we comply with GDPR and similar regulations while maintaining our ability to operate and improve the platform.

Data Retention: We keep data indefinitely because it helps us serve you better over time and maintain the integrity of our platform, even after accounts close.

Fees and Payment (Keeping It Simple and Fair)

Subscription Fees

Our subscription fees are clearly posted, and frankly, they’re pretty reasonable for what you get. These fees are non-refundable once you’ve started using the platform, except in two specific situations: if we have a technical failure that prevents you from using our services, or if someone fraudulently uses your payment information in criminal activity.

Transaction Fees for Free Accounts

If you’re on a free account, you’ll pay transaction-based fees when deals close. The specific amounts and terms are laid out in the referral agreements you’ll sign for each transaction. This keeps the platform accessible to everyone while ensuring we can maintain and improve our services.

Our Payment Philosophy

We process payments through trusted third-party providers, and we’re pretty straightforward about our no-refund policy. Once services are provided or you’ve used the platform to facilitate referrals, fees are final. We think this is fair because we’ve delivered value, and it helps us keep costs low for everyone.

Your Content and Our Platform

What You Bring

Everything you upload – photos, bios, transaction history – stays yours. But by sharing it with us, you’re giving us permission to use it to operate the platform and achieve our mission of industry advancement.

What We’ve Built

Our platform, features, technology, and algorithms represent years of development and investment. These remain our property, and we’re pretty protective of them (as you’d expect!).

Respecting Our Partners

We work with some amazing brokerage partners, and their brands and logos are precious to them (and to us). Please don’t use any brand names or logos without express permission – this could result in immediate account termination.

COMMUNICATION AND NOTIFICATION

Required Service Communications

Referral Flow is built on real-time communication of referral opportunities and platform updates. By creating an account, you expressly consent to receive:

  • SMS text messages regarding referral opportunities, matches, and time-sensitive alerts
  • Email notifications about referral opportunities, account activity, and platform updates
  • System-generated messages essential to the operation of your account

This consent is required to use Referral Flow. These communications are not marketing—they are the core functionality of our service. If you opt-out of these required communications, we will deactivate your account as you will no longer be able to effectively use the platform.

For SMS Messages:

  • Message and data rates may apply based on your mobile carrier’s plan
  • Message frequency varies based on referral activity but may include multiple messages per week
  • To opt-out, reply STOP to any SMS message (note: this will result in account deactivation)
  • Reply HELP for assistance
  • Supported carriers include all major U.S. carriers

For Email Communications:

  • You may receive multiple emails per week depending on referral activity
  • To opt-out of required service emails, you must close your account by contacting support

Your Consent: By providing your mobile phone number and email address, you represent and warrant that:

  • You are the current subscriber or customary user of that mobile number
  • You have the authority to consent to receive communications at that number and email address
  • The mobile number you provide is not on any state or federal Do Not Call registry, or you consent to receive calls despite such registration

Optional Marketing Communications

Separately from required service communications, you may opt-in to receive:

  • Promotional SMS messages about platform features, events, and special offers
  • Marketing emails about Referral Flow updates, industry insights, and partner offers

These marketing communications are completely optional and are not required to use Referral Flow. You may opt-in or opt-out at any time:
To Opt-Out of Marketing SMS: Reply STOP to any marketing text message. This will only stop marketing messages; you will continue to receive required service communications.
To Opt-Out of Marketing Emails: Click the “unsubscribe” link at the bottom of any marketing email. This will only stop marketing messages; you will continue to receive required service emails.

Push Notifications

We may send push notifications through your web browser or mobile device to alert you of time-sensitive referral opportunities. These notifications are controlled through your browser or device settings, not through Referral Flow. You can enable or disable push notifications at any time through your device settings without affecting your account.

Communication Methods and Automation

We may use automated telephone dialing systems, artificial or pre-recorded voices, and automatic email systems to deliver communications. By consenting to receive communications, you agree to receive messages sent via these automated methods.

Broker Contact Requirements

As noted in the “Who Can Join Our Community” section, we may need to contact your designated broker for referral agreement execution and transaction coordination. By providing your broker’s contact information, you confirm you have notified them of this requirement.

Changes to Contact Information

You are responsible for keeping your mobile number and email address current in your account settings. We are not responsible for failed communications due to outdated contact information. If you change your mobile number or email address, you must update your account immediately and your previous consent will apply to the new contact information.

Costs and Charges

Referral Flow does not charge for SMS messages or emails, but your mobile carrier’s standard message and data rates apply to all SMS communications. You are responsible for all charges imposed by your mobile carrier. Please check with your carrier regarding your messaging plan and rates.

Revocation of Consent

You may revoke your consent to receive communications at any time using the opt-out methods described above. However, revoking consent to required service communications will result in immediate account deactivation, as these communications are essential to platform functionality. Any referral agreements or fee obligations in effect at the time of revocation will remain binding.

Account Management (We Hope This Never Comes Up!)

When Accounts Get Terminated

We really hope this never happens, but sometimes we need to modify, suspend, or terminate accounts. This might be for violations of these terms, fraudulent activity, licensing issues, platform abuse, quality control, or just business decisions we need to make.

When we make these decisions, they’re final. You can always reach out to discuss what happened, but we maintain complete discretion over account status.

What Happens After Termination

If your account is terminated, you lose access to the platform, but any fee obligations for completed transactions remain in effect. We keep all data and content indefinitely for business and legal purposes.

Legal Protections (The Stuff Our Lawyers Insist We Include)

Your Promises to Us

By using the platform, you’re representing that you have the authority to enter these terms, all your information is accurate, you’ll follow applicable laws, and you have necessary permissions from your broker.

What We Can’t Promise

We provide the platform “as is” and can’t guarantee specific results, referral opportunities, or transaction outcomes. Real estate is complex, and success depends on many factors beyond our platform.

Limiting Our Liability

Our liability is limited to the fees you’ve paid us in the preceding twelve months. We’re not responsible for indirect damages or consequences beyond our direct control.

Your Protection of Us

If someone brings a claim against us because of how you used the platform, you agree to protect us and cover any costs. This seems fair since you’re in control of how you use our services.

Resolving Disagreements (Hopefully Never Needed!)

We’re all professionals here, so if something goes wrong, let’s handle it professionally:

  1. Talk It Out First: Before anything formal, we’ll spend 60 days trying to resolve any issues through good faith discussion.
  2. Mediation: If talking doesn’t work, we’ll try mediation in California with a neutral mediator.
  3. Arbitration: If mediation doesn’t resolve things, we’ll use binding arbitration through the American Arbitration Association in California.
  4. No Class Actions: We’ll resolve things individually rather than through class action lawsuits. This is typically faster and more personal.
  5. California Courts: For anything that can’t be arbitrated, California state or federal courts will handle it.

California Broker Disclosure

Since we’re a licensed California broker, we want to be clear: we facilitate connections between agents, but you maintain your own client relationships and transaction management. We’re the technology and connection facilitator, not the agent managing your deals.

Final Thoughts

These terms represent our complete agreement, and they’re governed by California law (except arbitration, which follows federal law). If any part becomes unenforceable, we’ll modify it minimally to make it work while keeping the original intent.

We can assign these terms if needed (like if we’re acquired by another company), but you can’t assign them to someone else.

The important parts – fees, data usage, intellectual property, liability protection, and dispute resolution – continue even after accounts are terminated.
